TERMS AND CONDITIONS

Please read carefully the following Terms and Conditions. By registering for and participating in the production, you are deemed to have agreed to these Terms and Conditions and agree to fully comply with them.

1. Photographic Materials.
​
All photographic materials, including but not limited to digital negatives, transparencies, proofs, and previews, and digital files shall be the exclusive property of Ksenia Senshina Photography. The client agree that, without signing for "Keep It Private" Option, Ksenia Senshina Photography may use any images created during your commissioned session for display, marketing, advertisements and exhibits without any additional compensation to you.

The client will be given a dvd, memory stick or link to the their private online gallery, with all edited images. The photographs may only be used for private purposes. For a commercial use of photographs a written permission from Ksenia Senshina Photography has to be obtained. These images are not to be altered or edited in any way by anyone other than Ksenia Senshina Photography. When sharing or publishing the images, please include reference to the photographer.

2. Package Fee & Cancellation Policy.
​
The package fee pays for the time and expertise of the photographer, post processing and retouching images and production printed products (where applicable). The fee is due at the time of the scheduled photo session.

Client understands that by entering into this agreement, photographer is foregoing other photographic jobs. In the event of a cancellation of the Session fees are non-refundable. Any cancellations with less than 24 hours notice are subject to a cancellation fee of CHF 100. If you have a sick child on the day of the session please call to reschedule.

If Ksenia Senshina Photography cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Ksenia Senshina Photography’s illness, then Ksenia Senshina Photography shall reschedule the session within 2 weeks of the cancelled appointment or return any monies paid, excluding monies paid for any services already fulfilled, to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Ksenia Senshina Photography. In the event Ksenia Senshina Photography fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

3. Inherent Qualities.
​
The client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client releases Ksenia Senshina Photography from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities. Client is also aware that dvd’s and cd’s are also not a permanent storage for images and must be backed up and archived by the client. Ksenia Senshina Photography is not responsible for the loss of images or for maintaining backups of the client’s images once they have been delivered to the client.

4. Limited Liability.
​
You agree to hold harmless Ksenia Senshina from any legal dispute. In the event you become injured during your session, Ksenia Senshina Photography and its representatives will not be held liable for any injury incurred by you or your family or third parties. The same applies to an unlikely event of damage to your property during the photo-session.

5. Model Release.
​
In exchange to 3 free retouched images Client give Photographer permission to display selected images resulting from this assignment as an example of Photographer's work. Clients name will not be used online or offline if the photographs are displayed. If the client don't wont to have 3 extra images, Photographer will ask the permission to display selected images.

5. Prints Policy.
​
The client is allowed to place an order for 14 days after gallery preparation. The Photographer requires payment in full from the Client on all orders placed. Orders will only be processed when payment has been made. Due to the custom nature of the products produced, orders cannot be canceled and all payments are non-refundable. Returns are not accepted on prints or all other products including but not limited to photo prints, canvases, metal prints, books, standout prints, cards, and all other products.

6. Delivery.
​
Ksenia Senshina Photography will endeavor to deliver digital files as quickly as possible. However this could take up to 4-5 weeks during busy periods.
